We handle all aspects of Probate and Estate Administration for estates in Scott County, Dakota County, Hennepin County, Carver County, Ramsey County, Sibley County, Mcleod County, Le Sueur County, Anoka County and other surrounding Minnesota counties.
Probate is the legal process by which a person’s will is allowed by the Probate Court. The provisions of the will dictate how the individual’s debts are paid and assets are distributed upon death. Estate Administration includes the probate process as well as non-probate transfers of the deceased’s assets, such as life insurance, annuities, qualified plans, and trust assets and compliance with applicable estate tax requirements.
The firm assists the personal representative of the estate in the gathering, valuation, accounting and distribution of the decedent’s assets. The lawyers prepare federal and state estate tax returns as well as the appropriate documents in order to release liens on a decedent’s real estate. It is the firm’s responsibility to assure that all steps are properly taken in order to carry out the decedent’s intent in accordance with the law.
Similarly, the firm assists trustees in performing their obligations under a trust, and has served as an independent trustee for many individuals looking for objective and learned oversight of trust assets.

Our attorneys have assisted clients throughout the greater Twin Cities metro area by creating tailored estate planning solutions to meet their needs. From “simple” wills without tax planning, to complex credit shelter and cabin trusts, our attorneys can help you control the distribution of assets upon death while simultaneously avoiding unnecessary taxes, costs and expenses. Our lawyers have done this for over 30 years.

We are up-front with clients and tells them what type of plan they should have, and what it will cost to get there. We are not a trust mill – needlessly telling clients to make complex estate plans when they don’t really need them. Call one of our trusted estate planning lawyers to find out if you need an estate plan to carry out your wishes after death.

Small businesses and start-ups often lack the budget to hire in-house counsel, or, are organized in such a way that an in-house legal team isn’t appropriate. More established businesses, too, chose not to have in-house counsel due to cost considerations and the inherent difficulty of managing complex legal issues without a larger office staff  offered in a law firm environment. However, these businesses still frequently have questions about how to maximize their bargaining power in contracts, about compliance with federal, state and local laws, as well as more general corporate legal issues, and in each situation the business would be well served by a lawyer providing specialized analysis and proposed solutions.

JMW understands a business’ struggle with the desire to have seasoned legal counsel, but at the same time grappling with limited funds to provide for that service. We help businesses bridge the gap by offering our services as “outside, in-house counsel.” Our lawyers can advise on the day-to-day operations of the business providing advisory opinions on issues at hand. We can also participate in board meetings and other planning sessions, or in response to specific requests for advice on general corporate matters like drafting contracts and negotiating their terms, as well as risk assessment and mitigation.

Serving as outside in-house counsel also provides clients with a direct conduit to JMW’s experienced litigators who have the practical skills needed to zealously represent our clients. Our team can also help manage litigation in foreign jurisdictions by locating and managing outside counsel and providing clients with an insider’s view on the litigation process, legal billing, and tips on maximizing the effectiveness of their other lawyers.

We  provide these services hourly on demand, but also through alternative billing structures like monthly all inclusive retainers and project based flat fees. Please give us a call if outside in-house counsel can help give your business that competitive advantage you need to grow and succeed.

We represent individuals who have been injured as a result of an unsafe product that was designed, manufactured, sold, and/or furnished by a person or company. We assist those injured individuals in bringing their claims and being fairly compensated for their injuries. Call to speak with one of our lawyers today at (952) 445-2817.
Medical negligence or “malpractice” occurs when a physician or healthcare provider either fails to do something that should have been done or does something that should not have been done which results in injury or death. Doctors and other health-care providers must follow certain standards when caring for patients. While a simple mistake is not enough to constitute negligence, a death or injury caused by the failure to provide reasonably appropriate or common standards of care or the failure to diagnose an easily detectable illness may be malpractice.

We aggressively investigate and pursue claims for catastrophic injuries and death arising out of:

  •     Nursing Home Abuse and Neglect
  •     Birth Trauma
  •     Failure to Diagnose Cancer and Other Diseases
  •     Inappropriate or Negligently Performed Surgery
  •     Disfigurement
  •     Inappropriate or Dangerous Treatment Practices
  •     Pharmaceutical Injuries and Prescription Drug Errors
  •     Psychiatric/Mental Health Malpractice or Negligence.

We are experienced in health care and medical malpractice lawyers who can help clients determine whether or not malpractice has occurred where someone is injured as a result of negligence or misconduct of individuals in the dental, medical, podiatry, chiropractory, psychiatry, and other health professional fields.
